Lawsuit settlement means money for some shoppers

It's not every day a trip to the store results in your personal information getting stolen. But that's what happened a few years ago at TJ Maxx and Marshalls -- and now the stores are paying for it.

'TJ Maxx agrees there was a security breach to confidential data and people may have been exposed to identity theft.'

The company agreed to a multi-million dollar class action settlement - and you could reap the benefits. If you made a return without a receipt and received a letter from TJ Maxx notifying you that your information may have been compromised, you're eligible for 3 years of credit monitoring and identity theft insurance. If you made a purchase with your credit or debit card in 2003 or 2006, you could be eligible for additional benefits including 60 dollars in vouchers or a cash benefit of up to 30-dollars.

'If person was regular shopper, they could get some benefits on word alone.'

You don't need proof, but you have to be willing to sign this affadavet saying you incurred some type of out of pocket expense as a result of the breach.

"If you had to pay for credit report, that would be example of out of pocket expense.'

It's that catch that has frequent shoppers like Candy Evans saying it's not worth it.

Iit would be hard to go back that far - most people don't keep receipts that long.'

Marshalls shoppers probably aren't the last to be part of a class action settlement. With more and more security breaches across the nations, more settlements could be on the way.

Jensen says he wouldn't be surprised if shoppers of big box stores like circuit city and best buy see some type of settlement, following a security breach with their check authorization system last summer.

"Iit would not surprise me if every chain store would be held to high level of accountability.'

'The issue is are stores protecting private information well enough through computer systems.'
