Law officers named Chastain as a person of interest after the shooting death of Powers on Tuesday afternoon. Friday morning, they informed him of the charges that he now faces: first-degree murder, being a felon in possession of a firearm, and committing a felony with a firearm.
“He's charged with killing the victim with gunfire,” said Boone County Prosecuting Attorney Ron Kincade.
A detective’s affidavit used as the basis for the charges provides some details about Powers’ death. It says Chastain's mother, Barbara Burk, called police.
According to the affidavit, Chastain drove from Powers’ home near Omaha to his mother's house in Hollister, Mo. He dropped some of Powers' pets at Burk’s home and, Burk told the detective, Chastain admitted he killed his girlfriend.
According to Burk, Chastain claims he and Powers were arguing before he shot her first in the chest because “she was cussing him and threw a glass of whiskey in his face. Burk said that Chastain told her that he shot her in the chest and that she was still cussing him and suffering, so he shot her in the head. Burk indicated that Chastain told her that she didn’t deserve what she got, but she was mean.”
Also Tuesday afternoon, according to the detective, a friend of both Powers and Chastain tried to get hold of Powers on her cell phone. When Charles Hanson called her, Hanson told the detective, Chastain answered, and told him he had shot and killed Powers.
The detective said, after the shooting, Chastain kept Powers’ phone, over which he spoke with law enforcement officials. At one point, the detective wrote, Chastain made arrangements to turn in himself but he never appeared at the Boone County Sheriff's Department.
Law officers arrested Chastain on Thursday in Galena, Mo., after a couple saw a report about him on KY3 News and contacted police. Investigators set up camp in a motel room next door to one rented by Chastain and caught him as he was leaving. After being arrested, he waived his right to extradition hearings, and deputies brought him back to Harrison.
A judge scheduled Chastain’s next court appearance for July 10. He’s in the Boone County jail in lieu of a $2 million bond. His next court appearance is scheduled for July 10.
