OZARK, Mo. -- The Christian County prosecuting attorney formally charged the Nixa mayor with misdemeanor driving while intoxicated on Wednesday. A state trooper cited Brian Hayes after a traffic stop about 1 a.m. Sunday.
A Nixa police officer pulled over Hayes, 42, on U.S. 160 just south of South Street in Nixa. The officer then requested help from the Highway Patrol to avoid a conflict of interest. Hayes was released to a sober driver after he was booked into the Christian County Jail. That's a common procedure on misdemeanor DWI citations.
Hayes issued a statement that says he's deeply sorry, embarrassed and ashamed by the DWI charge. He said he should never have put himself in that position. He also commended the Nixa police officer for his professionalism in handling the traffic stop, which occurred after a lane violation.
The state trooper also ticketed Hayes for failure to produce proof of insurance. Prosecuting Attorney Ron Cleek says that charge would be dropped if Hayes shows he had insurance but didn't have a card in the vehicle with him. Hayes says that's the case.
Hayes could receive a county jail sentence as long as six months and/or a fine up to $500 if he's convicted on the DWI charge. The insurance citation carries a potential penalty of
up to 15 days in jail and/or a fine of up to $300. His first court
appearance is set for July 21.
